Welcome to FoodDart! These Terms and Conditions ("Terms") govern your use of the FoodDart mobile application and website (collectively, "Platform") operated by NOYO EV INDIA PRIVATE LIMITED ("Company," "we," "us," or "our"). By accessing or using our Platform, you agree to be bound by these Terms.

1. DEFINITIONS
•    "User" refers to any individual or entity using the FoodDart Platform.
•    "Restaurant Partner" refers to restaurants or food vendors listed on the Platform.
•    "Delivery Partner" refers to individuals providing delivery services through the Platform.
•    "Order" means a request placed by a User for food and beverages through the Platform.

2. ACCOUNT REGISTRATION
•    Users must be at least 18 years old to register.
•    Users are responsible for maintaining the confidentiality of their account credentials.
•    The Company reserves the right to suspend or terminate accounts at its discretion.

3. ORDERING AND PAYMENT
•    Users can place orders through the Platform from listed Restaurant Partners.
•    Prices displayed on the Platform include applicable taxes but may exclude delivery charges.
•    Payments must be made through available payment options (credit/debit cards, UPI, wallets, etc.).
•    Orders cannot be cancelled once placed, unless permitted by the Company’s cancellation policy.

4. DELIVERY TERMS
•    Estimated delivery time is provided for reference only and may vary.
•    The Company is not responsible for delays due to unforeseen circumstances.
•    Users must ensure correct delivery details are provided. Any failure in delivery due to incorrect details will be the User’s responsibility.
•    Once the order is placed your order will be delivered within max 1-2 hours.

5. REFUNDS AND CANCELLATIONS
•    We don't provide refund or return on our products as it food product.
•    In case of issues like incorrect or missing items, Users must report within 24 hours.
•    The Company reserves the right to approve or deny refund requests at its discretion.
•    If approved, you’ll be automatically refunded and credited on your original payment method within 1-2 days.

6. USER RESPONSIBILITIES
•    Users must not misuse or exploit the Platform for unlawful activities.
•    Users must not engage in abusive behaviour towards Restaurant Partners, Delivery Partners, or other users.
•    The Company may suspend or terminate User accounts for violations of these Terms.

7. LIABILITY AND DISCLAIMERS
•    The Company acts as a facilitator between Users, Restaurant Partners, and Delivery Partners and is not liable for food quality, safety, or delivery delays.
•    The Platform is provided on an "as-is" basis. We make no warranties regarding uninterrupted service, accuracy, or reliability.
•    The Company’s liability is limited to the maximum extent permitted by law.

8. INTELLECTUAL PROPERTY
•    All content on the Platform, including trademarks, logos, and proprietary material, is owned by or licensed to the Company.
•    Users are not permitted to copy, reproduce, or distribute Platform content without permission.

9. PRIVACY POLICY
•    Users agree to the terms of our Privacy Policy, which governs the collection and use of personal data.

10. TERMINATION
•    The Company reserves the right to terminate or suspend User accounts for violations of these Terms.
•    Users can terminate their accounts by contacting customer support.

11. GOVERNING LAW AND DISPUTE RESOLUTION
•    These Terms shall be governed by the laws of India.
•    Disputes will be resolved through arbitration in [Alwar], India, in accordance with the Arbitration and Conciliation Act, 1996.

12. MODIFICATIONS TO TERMS
•    The Company reserves the right to modify these Terms at any time.
•    Continued use of the Platform after modifications constitutes acceptance of the new Terms.
